Delivery & Returns Policy
When you buy from the Porsche Design Online Shop ([porsche-design.com.sa]) we want you to be happy with your purchases. However, we know occasionally the need to return a product may arise. You have the right to request withdrawal from the sale contract with SAMACO (the “Vendor”) within five (5) days from the date on which you received the products purchased from the Porsche Design Online Shop.
You can request the return and refund by online submission to the Vendor of the Return Form found in the Customer Care area, completed in its entirety; in this instance, the Vendor will send you an email confirming they have received your return request and the address to which the returns must be sent. The products to be returned must be handed over to the courier within five (5) days of the date you received the products purchased on the Porsche Design Online Shop. In case you withdraw from the sale contract, you are not allowed to ask the replacement of the initially purchased item with another item unless the corresponding right is explicitly provided by the Vendor.
The right to request return is excluded in the event you purchased customized or personalized products, or sealed items that were opened after delivery and that cannot be returned for health or hygiene reasons.
Conditions for exercising the right to request withdraw
The right to request withdrawal from the sale contract shall be deemed correctly executed if the following conditions have been fully met:
The right to request withdrawal has been correctly exercised within five (5) days of receiving the products following the procedures set out above;
The products have not been used, worn or washed and, in any case, compliant with the requirements detailed on Compliance Checks below;
The identification tag with the disposable seal is still attached to the products as it constitutes an integral part of the product;
The original box and packaging should be returned and undamaged and in resalable condition.
The products are handed over to the courier within five (5) days of the date you received the products purchased on the Porsche Design Online Store;
The products are not damaged.
If you have complied with the relevant conditions, the Vendor will reimburse the price of the products purchased. You will be notified if the returned products cannot be accepted because they are not compliant with the conditions set out in (a) through (f) above, and you can choose, at your own expense, to have the products returned to you. If you refuse said delivery, the Vendor reserves the right to retain the products and the amount paid for the purchase of the products.
Procedure for returning products to the Vendor
You can ship your returns to the Vendor with a shipping service of your choice and the return shipping will be at your own expense. For further assistance, please visit our Customer Care area.
The Vendor highly recommends that you choose a shipping service that permits you to trace the delivery at any time.
Compliance checks for returned products
Our products must be returned in a new and unused state, in perfect condition, with all protective materials in place and tags and stickers attached to them (if applicable), including all accessories and documents. We reserve our right not to accept any return if the product shows signs of wear or has been used or altered from its original condition in any way or, as an alternative, may reduce the amount of any applicable refund or exchange accordingly.
Refund times and procedures
4.1 Once the Vendor has received the returned products and checked all requirements have been met, you will receive an email confirming that the return has been accepted and the Vendor will proceed with a full refund, or, if the products are found to have decreased in value, you will receive an email informing you of the amount deducted from the refund and the Vendor will proceed with the refund of the remaining amount (if any). Whatever the form of payment used, the Vendor will process the refund within thirty (30) days from the date it was informed of your decision to request a refund, and once it has checked that the return was carried out in compliance with the above conditions. The time period for refunding the amount paid for purchasing the returned products depends on the form of payment used:
Purchase by credit/debit card: refund time will depend on the card company.
Payment made by cash on delivery (if available): we will refund to the bank account indicated by you, so the time taken for the refund will depend on the accuracy of the information provided by you; the refund will usually take thirty (30) days.
4.2 All refunds from Vendor to the Buyer shall be subject to the below conditions:
(a) Refunds will only be issued through the original mode of payment.
(b) The Buyer must request a refund of their payment within thirty (30) days of purchase.
(c) A refund will only be issued if the original receipt voucher is available.
(d) The processing time for a refund is thirty (30) working days.
Items returned because they are damaged, defective or incorrect
Without prejudice to the application of mandatory consumer protection provisions, if you are returning a product because of an error on our part or because it is damaged or defective, please notify the Vendor within five (5) days of receipt using the online Return form on the website; if a product becomes faulty after five (5) days, please contact Customer Care to obtain further returns information. You must return the products in the same condition in which you received them. For returning the products, please see section 1 and 2 above.
The Vendor will examine all products returned as damaged or defective and will notify you of your refund (if any) via email within a reasonable period of time. Subject to acceptance by the Vendor of the damaged or defective goods, products returned by you because you received them in a damaged or defective condition will be refunded in full, including the cost of delivery for sending the item to you and the cost incurred by you in returning the item to the Vendor. In the event that the Vendor finds no fault with the returned products, you will be notified that the returned products cannot be accepted and you may elect to have the products re-delivered to you. If you do not accept re-delivery, the Vendor reserves the right to retain the products and the purchase price and recover the Vendor's fees and expenses.
6. Identification Tag
We remind you that all products sold by the Vendor include an identification tag attached with a disposable seal which is an integral part of the product. Where applicable, please try on the products without removing the tag and seal. Products returned without the tag and seal will not be accepted.
7.1. The Vendor shall make no delivery until payment has been received or shall make delivery concurrently against payment. The delivery time is normally approximately 5 working days (for shipping within the Kingdom of Saudi Arabia) from receipt of payment, up to, but not exceeding 30 working days after the release of the payment.
7.2. The Buyer may request that delivery of the merchandise shall take place at the Porsche Design storefront, if any, specified by the Buyer. The Buyer shall make all arrangements necessary to take delivery of the merchandise.
7.3. Notwithstanding clause 7.2, the Buyer may request to have the merchandise shipped to an address designated by the Buyer subject to the following terms:
Vendor may, at its discretion, refuse to ship merchandise and insist the merchandise be delivered to the Buyer at a Porsche Design Store.
Risk of loss for the merchandise passes to the Buyer upon delivery of the merchandise to the postal carrier service provider. It is the Buyer’s responsibility to file any claims with the carrier for damaged and/or lost shipments.
7.4. The Buyer shall be responsible for bearing the shipping cost and all VAT, export taxes, and other fees associated with the delivery of the merchandise.
7.5 Any dates quoted for delivery to the Buyer are approximate only and not binding upon Vendor. Time for delivery shall not be of the essence due to some circumstances beyond Vendor’s control including, without limitation, production, shipment or transportation.
7.6 Upon physical delivery of the merchandise to the Buyer by Vendor or, in case of shipment to the Buyer, upon collection of the merchandise by the postal carrier service provider, Vendor shall be released from all liability towards the Buyer in relation to the merchandise, and all responsibilities and risks associated after date and time of physical delivery will be the responsibility of the Buyer.
8. Force Majeure
The Vendor shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, pandemic, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the Vendor shall be entitled to a reasonable extension of its obligations. If the delay persists for such time as the Vendor considers unreasonable, it may, without liability on its part, terminate the sale contract.
These conditions are an integral part of the General Terms and Conditions of Sale and are governed by the law of the Kingdom of Saudi Arabia.
